Announcement on the Preliminary Ruling of the Anti-dumping Investigation on Imports of Polyphenylene Ether Originating in the United States (MOFCOM 2021 No. 21)

On August 3, 2020, in accordance with the provisions of the Anti-dumping Regulations of the People’s Republic of China (hereinafter referred to as the “Anti-dumping Regulations”), the Ministry of Commerce of the People's Republic of China (MOFCOM, hereinafter referred to as the Investigation Authority) issued an announcement deciding to conduct anti-dumping on imports of polyphenylene ether originated in the United States (hereinafter referred to as the product under investigation) file an investigation.

 

Based on the results of the investigation and the provisions of Article 24 of the Anti-dumping Regulations, the Investigation Authority made a preliminary ruling. The relevant matters are hereby announced as follows:

 

1. Preliminary ruling

The Investigation Authority made a preliminarily ruling that there was dumping of imports of polyphenylene ether originated in the United States, and the domestic industry in China was substantially damaged, and there was causal relationship between the dumping and the substantive damage.

 

2. Levy of deposit

In accordance with Article 28 and Article 29 of the Anti-dumping Regulations, the Investigation Authority decides to implement temporary anti-dumping measures in the form of a deposit. Starting from September 7, 2021, when importing products under investigation, import operators shall provide corresponding deposits to the Customs of the People’s Republic of China (hereinafter referred to as the “the Customs”) on the basis of the dumping margin of each company determined in this preliminary ruling.

The tariff line of the product under investigation is 39072090 under the Rules of the People's Republic of China for the Import and Export Tariffs, products other than polyphenylene ether under this tariff code are not within the scope of this investigation.

The rates of deposit imposed on each company is as follows:

SABIC Innovative Plastics US LLC 18.3%

All other U.S. companies 48.6%

 

3. Method of levying deposit

The deposit is calculated and levied based on the dutiable value authorized by the Customs, and the calculation formula is:

Deposit Amount = ( dutiable value authorized by the Customs × Deposit collection rate) × (1 + the import link value-added tax rate).

 

4.Comments

All interested parties may submit written comments to the Investigation Authority within 10 days from the date of this Announcement.
